Raw Nutrition Protein Shake Lawsuit Explained

Raw Nutrition Inc. has been the subject of a class action lawsuit claiming that the protein shakes it sells do not have the amount of protein stated on the label.

A consumer called Daniel Ruchman brought the lawsuit in California federal court alleging the business misstated the protein level in its Raw Isolate Protein shakes.

Claims in the Case

The lawsuit claims that the product’s packaging says that each shake has 30 grams of protein per serving. The plaintiff claims, nevertheless, that independent testing shows lower actual protein levels than those promoted.

Around 26 to 28 grams of protein per serving were found in different tastes of the shakes in reported laboratory tests, depending on the variation. This discrepancy has fueled allegations that consumers were duped regarding the nutritional worth of the product.

The shakes come in a variety of flavors, including chocolate, vanilla, strawberry, cookies and cream, salted caramel, and mocha latte. They are sold as nutritious meal replacement beverages created for health-conscious consumers and gym users.

Consumer Concerns

The lawsuit claims that many consumers depend on correct labeling for fitness objectives, muscle recovery, and diet planning, therefore protein content is a key component. This is why even minor variations between stated and actual protein levels are regarded crucial.

The complaint also alleges that the product’s label prominently displays “30g protein”, which could have affected buying choices. The plaintiff claims that these claims may have led some consumers to pay more.

Legal Claims and Demands

The lawsuit makes a number of legal claims, among them:

  • Violations of California consumer protection statutes
  • Violation of an express warranty
  • Unfair enrichment
